Last summer, to overcome the crisis in the electricity sector, which was formed earlier, acting on behalf of the state of Ukraine, the Cabinet of Ministers of Ukraine undertook to resume payments to the State Enterprise “Guaranteed Buyer” to electricity producers from RES, and by the end of 2020 year to repay 40% of the debt to RES generation.
As of January 5, 2021, 40% of the debt has not been repaid. Also, SE “Guaranteed Buyer” has debts to producers of RES according to the calculations for November and December 2020.
On January 6, NERC plans to approve the Resolution (concerning OSP loans for debt repayment to SE “Guaranteed Buyer”), which restricts the right of the State Enterprise “Guaranteed Buyer” to use credit funds raised by TSO and transferred to SE “Guaranteed Buyer”. before RES.
Because of the above, the Solar Energy Association of Ukraine addressed the Prime Minister of Ukraine and the Chairman of the National Commission for Solar Energy of Ukraine with the request:
1) refrain from making deliberately illegal decisions of the NERC, which will lead to a significant increase in the number of lawsuits and arbitration claims by companies producing RES;
2) to resume dialogue with the participants of the renewable energy market as soon as possible find compromise solution of the critical situation with debts to producers from renewable energy sources, which threatens the investment image of Ukraine and the image of the state as a warrantor of the undertaken obligations.
