On June 9, 2021, a press conference “Memorandum that was not going to be fulfilled” was held with the participation of Artem Semenyshyn, Director of the Solar Energy Association of Ukraine, Oleksandr Kozakevych, Head of the Ukrainian Renewable Energy Association, Oleksandra Humenyuk, Chairman of the Board of the Ukrainian Wind Energy Association Andriy Konechenkov. The conference is dedicated to the anniversary of the signing of the Memorandum of Understanding with the Government of Ukraine.
Urgent issues of concern to all RES market participants were discussed. In particular, the speakers repeatedly raised the issue of the registered bill №5600 “On Amendments to the Tax Code of Ukraine and some legislative acts of Ukraine to ensure balanced budget revenues” and violation of Law №810, which guarantees the preservation of conditions for investors. Artem Semenyshyn said that the Solar Energy Association of Ukraine had sent a letter to the Energy Community Secretariat stating that the introduction of excise duty could jeopardize Ukraine’s compliance with renewable energy obligations and violate its obligations to investors, which would lead to international arbitration. It was noted about a new trend in lawsuits against the National Commission for Regulation of Economic Competition for norms and regulations that worsen the condition of producers. All this leads to the creation of a global negative investment image in absolutely all areas of the economy, and it’s not just about energy.
Also, the issues of arbitrations and debts were discussed: 34% for 2020, despite the fact that part of these funds had to be paid by the end of last year, and 9% for 2021. ”Obligations set out in the Law were not fulfilled – by November 2020 the Cabinet of Ministers of Ukraine had to initiate a bill on government bonds, and we can state that such a bill was not registered, respectively, we do not see sources for debt payments for last year and debt prevention this year.
According to estimates by the European Business Association, the introduction of the excise tax will lead to the fact that producers of “green” energy will incur losses of 1.63 billion hryvnias annually, “said the director of the Solar Energy Association.
