SEAU Held an Open Meeting of the Legal Committee on Law No. 4777-IX

The Solar Energy Association of Ukraine held an open meeting of its Legal Committee on the topic: “Law No. 4777-IX Is Already in Force: Overview of Key Changes for Market Participants.”

The event brought together representatives of businesses, developers, electricity producers, EPC companies, and other energy market stakeholders seeking to adapt their activities to the new legislative framework.

The session was led by Ivan Balytskyi, Head of the SEAU Legal Committee and a lawyer, one of the leading experts in energy law.

During the presentation, the expert outlined the key changes that have already entered into force, as well as their practical impact on the market:

  • “Green” auctions: the RES support model is changing with the introduction of a Feed-in-Premium mechanism;
  • Auction financial conditions: escrow accounts are introduced as an alternative to bank guarantees;
  • PV + BESS: defined as a priority area of state support (separate quotas and increased price cap—up to €0.12/kWh), alongside additional requirements for BESS (power ≥ 80% of PV capacity, storage duration – 2 kWh/kW);
  • Daytime generation constraints: the need to balance surplus generation through storage or curtailment during peak hours is introduced;
  • Night generation: time-based restrictions on purchasing electricity under the “green” tariff are introduced;
  • Grid connection: flexible connection without mandatory grid reconstruction is allowed, subject to capacity limitations;
  • Temporarily occupied territories (TOT): settlement mechanisms for electricity generated by RES facilities located in temporarily occupied territories and supplied to the Unified Energy System of Ukraine have been regulated.

Commenting on the significance of the changes, Ivan Balytskyi stated:

“Law No. 4777-IX opens new opportunities for energy market players, but at the same time requires rapid adaptation. The National Energy and Utilities Regulatory Commission (NEURC) has already established a working group and is expected to update key regulatory acts within the next six months. After that, the law will become fully operational. I encourage the expert community to join this process and submit proposals for the development of secondary legislation to ensure a favorable regulatory environment for the sector.”

SEAU will continue to inform the market about the outcomes of cooperation with the regulator.
