6th Energy Law Conference: Vladyslav Sokolovskyi Conducted a Special Interview and Moderated a Thematic Session

The Solar Energy Association of Ukraine (SEAU) became an information partner of the 6th Energy Law Conference organised by the Ukrainian Bar Association. As part of the event, SEAU Chairman Vladyslav Sokolovskyi conducted a special interview with the First Deputy Minister of Energy of Ukraine and moderated the conference’s first session.

The 6th Energy Law Conference took place on 24 July, bringing together representatives of government authorities, energy companies, investors, lawyers and industry experts to discuss current challenges and prospects for the development of Ukraine’s energy sector.

The key topics included energy recovery, attracting investment in new generation capacity, the development of renewable energy sources and energy storage systems, updates to the rules governing the electricity market, Ukraine’s integration into the European energy space, and current judicial practice.

The conference opened with Vladyslav Sokolovskyi, Chairman of SEAU, and Artem Nekrasov, First Deputy Minister of Energy of Ukraine.

During their conversation, they discussed the issues currently of greatest concern to investors and market participants: energy recovery, priority areas for attracting investment, the launch of the RAMP-UP mechanism to support new renewable energy projects, a new model for competitive tenders for the construction of generation facilities, Feed-in Premium auctions, as well as wartime regulatory simplifications that are already helping to accelerate the implementation of energy projects.

Special attention was also given to de-risking instruments for private investors, designed to help convert international financing into new megawatts of generation capacity. The participants also discussed support mechanisms that should remain in place after the end of martial law to ensure the continued development and investment attractiveness of Ukraine’s energy sector.

Following the special interview, Vladyslav Sokolovskyi continued his work at the conference as moderator of the first session, “Electricity Market: New Rules, Legal Disputes and EU Integration.”

During the session, leading experts discussed new market rules, financing for energy projects, integration into the European energy space and current judicial practice.

Kateryna Danylkova, Deputy Director for перспективні Projects at the JSC “Guaranteed Buyer”, spoke about the development of the “green” auctions, whose quota increased to 1 GW in 2026. She highlighted the transition to the Feed-in Premium model, simplified requirements for financial security and extended deadlines for submitting documents during the period of martial law.

Oleksandr Havva, CEO of JSC “Market Operator”, presented a vision for integrating the Ukrainian market with the European market through the market coupling mechanism. In particular, he discussed the implementation of the European Euphemia and XBID algorithms, the transition to 15-minute market time units and new price limits. At the same time, the fundamental principles of market operation will remain unchanged, while cross-border capacity allocation will be carried out automatically.

Olesya Mishchenko, Chair of the Management Board of JSC “Decarbonisation Fund of Ukraine”, presented preferential lending and leasing programmes for the implementation of energy projects. In particular, the programmes provide financing at 5–9% annual interest in Ukrainian hryvnias for projects involving the construction of solar power plants, cogeneration facilities, energy storage systems and thermal modernisation, with financing of up to UAH 90 million per project.

Oleksandr Hrechko, Head of the Regulatory Policy Department at PJSC “Ukrhydroenergo”, spoke about the legal aspects of aggregation and the establishment of virtual power plants with a capacity of up to 20 MW. He drew attention to the two-tier contractual model and the need for the full implementation of netting in accordance with EU regulations.

Serhii Savchuk, Member of the Board of the Bioenergy Association of Ukraine and Deputy Chairman of the Supervisory Board of JSC “URM”, emphasised the importance of RAB regulation for attracting bank financing for the modernisation of electricity grids. He also outlined a draft regulatory decision setting rates of return on the existing asset base at 3% and on the new asset base at 16.74%.

A separate part of the session was dedicated to current legal disputes in the electricity sector.

Maksym Yurkov, Director for Legal Affairs at NPC “Ukrenergo”, shared the company’s judicial practice regarding the settlement of imbalances in de-occupied territories, the specifics of charging 3% annual interest on advance payments, as well as the unjustified suspension of enforcement proceedings during the war.

Yevheniia Sudarikova, Senior Associate and Attorney at Law at LCF Law Group, analysed legal disputes concerning renewable energy imbalances following the annulment of NEURC Resolution No. 46. She noted that the case is awaiting consideration by the Grand Chamber of the Supreme Court, which should contribute to the development of a unified judicial practice. She also spoke about mediation processes involving the Energy Community.

The conference was also attended by representatives of SEAU member companies, including Atmosfera, Green System, ISO Company and Europower Enerji, as well as Ivan Balytsky, Head of the SEAU Legal Committee, Dmitro Lukomskyi, Head of the SEAU Investment Committee, and other representatives of the solar energy community.

SEAU thanks the organisers, the Ukrainian Bar Association, for the invitation and the opportunity for dialogue. The UBA and SEAU have a long-standing history of cooperation under a partnership memorandum, contributing to the development of legal support for participants in Ukraine’s renewable energy market.
