On November 2, a joint meeting of the Committee of Importers and Distributors, and the Committee on Legal Support of the ASEU Solar Energy Industry was held in an online meeting format.
During the meeting, the following issues were considered:
✅ coordination of proposals for reconstruction and change of the “green” tariff;
✅ state support for the installation of rooftop SPPs, the possibility of attracting investments, and establishing compensation for the installation of rooftop SPPs;
✅ guarantees of origin as a tool for attracting investments;
✅ consequences of the adoption of Resolution of the NEURC No. 1272 dated 05.10.2022.
The head of the legal committee of ASEU Olha Savchenko spoke about the current situation regarding the reconstruction and change of the “green” tariff, referring to the response of the NEURC to ASEU’s request on this matter. Taking into account the fact that the NEURC in its response recommends that market participants independently initiate changes to the legislation on the issue of reconstruction of objects damaged as a result of military actions, these proposals were prepared by Olga. In particular, it is proposed to make changes to the Law “On Alternative Energy Sources” as a matter of priority in the part that the “green” tariff is not subject to revision during the reconstruction of objects damaged as a result of military operations. According to the results of the discussion, the participants of the meeting decided to contact the Ministry of Energy of Ukraine with proposals for amendments to the Law “On Alternative Energy Sources” to settle the issue of reconstruction of objects damaged as a result of the russian`s military aggression against Ukraine.
In addition, ASEU Chairman of the Board Vladyslav Sokolovsky suggested that, based on the pilot project, namely regarding the installation of an autonomous rooftop SES on the hospital building, to find out and work out all the technical points that will arise in the process of implementing such a project, and what legal changes will need to be made to legislative acts to simplify and improve the procedure for installing rooftop SESs. The proposed position was collectively supported by the meeting participants.
ASEU lawyer Ulyana Mytnyk also spoke during the Committees’ meeting about the negative consequences for owners of home solar power stations, which are due to the adoption of Resolution of the NEURC No. 1272, which amended the Rules of the Retail Electricity Market.
Representatives of the Committees agreed to continue working in the same direction, to hold several more meetings to discuss and solve urgent issues in the solar energy industry.
