As part of the event, SEAU Chairman Vladyslav Sokolovskyi conducted a special interview with the First Deputy Minister of Energy of Ukraine and moderated the conference&#8217;s first session.<\/i><\/b><\/p>\n<p><span style=\"font-weight: 400;\">The 6th Energy Law Conference took place on 24 July, bringing together representatives of government authorities, energy companies, investors, lawyers and industry experts to discuss current challenges and prospects for the development of Ukraine&#8217;s energy sector.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The key topics included energy recovery, attracting investment in new generation capacity, the development of renewable energy sources and energy storage systems, updates to the rules governing the electricity market, Ukraine&#8217;s integration into the European energy space, and current judicial practice.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The conference opened with <\/span><b>Vladyslav Sokolovskyi, Chairman of SEAU<\/b><span style=\"font-weight: 400;\">, and <\/span><b>Artem Nekrasov, First Deputy Minister of Energy of Ukraine<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During their conversation, they discussed the issues currently of greatest concern to investors and market participants: energy recovery, priority areas for attracting investment, the launch of the <\/span><b>RAMP-UP<\/b><span style=\"font-weight: 400;\"> mechanism to support new renewable energy projects, a new model for competitive tenders for the construction of generation facilities, <\/span><b>Feed-in Premium<\/b><span style=\"font-weight: 400;\"> auctions, as well as wartime regulatory simplifications that are already helping to accelerate the implementation of energy projects.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Special attention was also given to <\/span><b>de-risking<\/b><span style=\"font-weight: 400;\"> instruments for private investors, designed to help convert international financing into new megawatts of generation capacity. The participants also discussed support mechanisms that should remain in place after the end of martial law to ensure the continued development and investment attractiveness of Ukraine&#8217;s energy sector.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Following the special interview, Vladyslav Sokolovskyi continued his work at the conference as moderator of the first session, <\/span><b>\u201cElectricity Market: New Rules, Legal Disputes and EU Integration.\u201d<\/b><\/p>\n<p><span style=\"font-weight: 400;\">During the session, leading experts discussed new market rules, financing for energy projects, integration into the European energy space and current judicial practice.<\/span><\/p>\n<p><b>Kateryna Danylkova, Deputy Director for \u043f\u0435\u0440\u0441\u043f\u0435\u043a\u0442\u0438\u0432\u043d\u0456 Projects at the JSC \u201cGuaranteed Buyer\u201d<\/b><span style=\"font-weight: 400;\">, spoke about the development of the \u201cgreen\u201d auctions, whose quota increased to <\/span><b>1 GW in 2026<\/b><span style=\"font-weight: 400;\">. She highlighted the transition to the <\/span><b>Feed-in Premium<\/b><span style=\"font-weight: 400;\"> model, simplified requirements for financial security and extended deadlines for submitting documents during the period of martial law.<\/span><\/p>\n<p><b>Oleksandr Havva, CEO of JSC \u201cMarket Operator\u201d<\/b><span style=\"font-weight: 400;\">, presented a vision for integrating the Ukrainian market with the European market through the <\/span><b>market coupling<\/b><span style=\"font-weight: 400;\"> mechanism. In particular, he discussed the implementation of the European <\/span><b>Euphemia and XBID algorithms<\/b><span style=\"font-weight: 400;\">, the transition to 15-minute market time units and new price limits. At the same time, the fundamental principles of market operation will remain unchanged, while cross-border capacity allocation will be carried out automatically.<\/span><\/p>\n<p><b>Olesya Mishchenko, Chair of the Management Board of JSC \u201cDecarbonisation Fund of Ukraine\u201d<\/b><span style=\"font-weight: 400;\">, presented preferential lending and leasing programmes for the implementation of energy projects. In particular, the programmes provide financing at <\/span><b>5\u20139% annual interest in Ukrainian hryvnias<\/b><span style=\"font-weight: 400;\"> for projects involving the construction of solar power plants, cogeneration facilities, energy storage systems and thermal modernisation, with financing of up to <\/span><b>UAH 90 million per project<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><b>Oleksandr Hrechko, Head of the Regulatory Policy Department at PJSC \u201cUkrhydroenergo\u201d<\/b><span style=\"font-weight: 400;\">, spoke about the legal aspects of aggregation and the establishment of virtual power plants with a capacity of up to <\/span><b>20 MW<\/b><span style=\"font-weight: 400;\">. He drew attention to the two-tier contractual model and the need for the full implementation of netting in accordance with EU regulations.<\/span><\/p>\n<p><b>Serhii Savchuk, Member of the Board of the Bioenergy Association of Ukraine and Deputy Chairman of the Supervisory Board of JSC \u201cURM\u201d<\/b><span style=\"font-weight: 400;\">, emphasised the importance of <\/span><b>RAB regulation<\/b><span style=\"font-weight: 400;\"> for attracting bank financing for the modernisation of electricity grids. He also outlined a draft regulatory decision setting rates of return on the existing asset base at <\/span><b>3%<\/b><span style=\"font-weight: 400;\"> and on the new asset base at <\/span><b>16.74%<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A separate part of the session was dedicated to current legal disputes in the electricity sector.<\/span><\/p>\n<p><b>Maksym Yurkov, Director for Legal Affairs at NPC \u201cUkrenergo\u201d<\/b><span style=\"font-weight: 400;\">, shared the company&#8217;s judicial practice regarding the settlement of imbalances in de-occupied territories, the specifics of charging <\/span><b>3% annual interest on advance payments<\/b><span style=\"font-weight: 400;\">, as well as the unjustified suspension of enforcement proceedings during the war.<\/span><\/p>\n<p><b>Yevheniia Sudarikova, Senior Associate and Attorney at Law at LCF Law Group<\/b><span style=\"font-weight: 400;\">, analysed legal disputes concerning renewable energy imbalances following the annulment of NEURC Resolution No. 46. She noted that the case is awaiting consideration by the Grand Chamber of the Supreme Court, which should contribute to the development of a unified judicial practice. She also spoke about mediation processes involving the Energy Community.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The conference was also attended by representatives of SEAU member companies, including <\/span><b>Atmosfera, Green System, ISO Company and Europower Enerji<\/b><span style=\"font-weight: 400;\">, as well as <\/span><b>Ivan Balytsky, Head of the SEAU Legal Committee<\/b><span style=\"font-weight: 400;\">, <\/span><b>Dmitro Lukomskyi, Head of the SEAU Investment Committee<\/b><span style=\"font-weight: 400;\">, and other representatives of the solar energy community.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">SEAU thanks the organisers, the <\/span><b>Ukrainian Bar Association<\/b><span style=\"font-weight: 400;\">, for the invitation and the opportunity for dialogue.
