{"id":22269,"date":"2026-03-13T13:11:45","date_gmt":"2026-03-13T11:11:45","guid":{"rendered":"https:\/\/aseu.org.ua\/?p=22269"},"modified":"2026-03-24T11:47:31","modified_gmt":"2026-03-24T09:47:31","slug":"five-rules-changed-by-law-no-4777-ix-for-the-energy-market","status":"publish","type":"post","link":"https:\/\/aseu.org.ua\/en\/five-rules-changed-by-law-no-4777-ix-for-the-energy-market\/","title":{"rendered":"Five Rules Changed by Law No. 4777-IX for the Energy Market"},"content":{"rendered":"<p><em><strong>Ivan Balytskyi, Chair of the Legal Committee of the Solar Energy Association of Ukraine (SEAU) and partner of SEAU\u2019s chief legal advisor \u2013 the law firm Sokolovskyi &amp; Partners, outlined the key changes for the energy market introduced by Law No. 4777-IX in an op-ed for the media outlet Energoreforma.<\/strong><\/em><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><b>Verkhovna Rada of Ukraine<\/b><span style=\"font-weight: 400;\"> adopted Law No. 4777-IX on <\/span><b>10 February 2026<\/b><span style=\"font-weight: 400;\">, and it entered into force on <\/span><b>11 March 2026<\/b><span style=\"font-weight: 400;\">. The legislation simultaneously serves as a crisis-response tool and a strategic roadmap. It introduces <\/span><b>five key changes<\/b><span style=\"font-weight: 400;\"> affecting renewable energy producers, industrial consumers, and other market participants.<\/span><\/p>\n<p><strong><i>Background<\/i><\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Law No. 4777-IX amends <\/span><b>15 legislative acts<\/b><span style=\"font-weight: 400;\"> and affects almost every participant in the electricity market \u2013 from owners of residential solar installations to the transmission system operator. Despite its lengthy official title \u2013 <\/span><i><span style=\"font-weight: 400;\">\u201cOn Improving the Functioning of Energy Markets, Competitive Conditions for Electricity Generation from Renewable Energy Sources, and Strengthening Energy Resilience\u201d<\/span><\/i><span style=\"font-weight: 400;\"> \u2013 its essence can be summarized in several key provisions.<\/span><\/p>\n<h5><b>RES Auctions Extended Until 2034 \u2013 with Real Financial Instruments<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">The first major change is the <\/span><b>extension of the renewable energy auction support horizon from 2029 to 2034<\/b><span style=\"font-weight: 400;\">. For the market, this is not a cosmetic adjustment: the development cycle of large renewable projects in Ukraine often takes several years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the support horizon were limited to 2029, banks would be unlikely to finance projects launched in 2026. The new timeline restores <\/span><b>predictability for project financing<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In parallel, the law obliges the <\/span><b>Cabinet of Ministers of Ukraine<\/b><span style=\"font-weight: 400;\"> to set an annual support quota by <\/span><b>1 December each year<\/b><span style=\"font-weight: 400;\"> and publish a <\/span><b>four-year indicative forecast<\/b><span style=\"font-weight: 400;\">\u2014a so-called <\/span><i><span style=\"font-weight: 400;\">\u201cvisible corridor\u201d<\/span><\/i><span style=\"font-weight: 400;\"> system already tested in the EU.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One participant or a group with the same ultimate beneficiary <\/span><b>may not receive more than 50% of the annual quota<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another important element is the introduction of <\/span><b>escrow accounts<\/b><span style=\"font-weight: 400;\"> as a full-fledged alternative to bank guarantees. Companies may deposit a guarantee contribution (\u20ac5\/kW for auction participation and \u20ac10\/kW for contract performance) into a blocked escrow account without requiring a credit line.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Escrow conditions are equivalent to bank guarantees, giving the <\/span><b>Guaranteed Buyer<\/b><span style=\"font-weight: 400;\"> the same rights of claim. In the context of wartime financial stress and reduced credit limits for many energy companies, this mechanism opens the door to auctions for investors who previously hesitated.<\/span><\/p>\n<blockquote><p>Support horizon until 2034 + escrow accounts as an alternative to bank guarantees = a significantly lower entry barrier for new renewable investors.<\/p><\/blockquote>\n<h5><b>Solar Power Plants with Energy Storage Become a Priority<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">For the first time, the law introduces <\/span><b>PV + energy storage systems (PV+BESS)<\/b><span style=\"font-weight: 400;\"> as a separate auction category with a <\/span><b>minimum quota of 10% of the annual support volume<\/b><span style=\"font-weight: 400;\"> \u2013 twice as much as for standalone solar or wind projects (each allocated 5%).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The storage requirements are strict:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">power capacity must be <\/span><b>at least 80% of the PV plant\u2019s generation capacity<\/b><b><br \/>\n<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">storage capacity must be <\/span><b>at least 2 kWh per 1 kW of installed generation capacity<\/b><b><br \/>\n<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">For example, a <\/span><b>100 MW solar plant<\/b><span style=\"font-weight: 400;\"> must be paired with at least <\/span><b>80 MW of storage capacity and 200 MWh of energy capacity<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The logic behind this provision is to enable <\/span><b>\u201cevening dispatch\u201d<\/b><span style=\"font-weight: 400;\"> of solar energy. Auction conditions require producers to <\/span><b>waive the market premium for two consecutive hours between 10:00 and 16:00<\/b><span style=\"font-weight: 400;\">, when solar generation peaks and <\/span><b>day-ahead market prices fall due to oversupply<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This mechanism encourages producers to <\/span><b>store solar energy during the day and dispatch it in the evening<\/b><span style=\"font-weight: 400;\">, when demand and prices are higher.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><b>maximum support price for this category is \u20ac0.12\/kWh<\/b><span style=\"font-weight: 400;\">, creating a competitive benchmark for PV+BESS projects.<\/span><\/p>\n<h5><b>Flexible Grid Connection: Connecting Even with Congested Networks<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">A tool widely used in EU countries for over a decade is now introduced into Ukrainian legislation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the grid lacks available capacity, developers may propose <\/span><b>\u201cflexible connection\u201d<\/b><span style=\"font-weight: 400;\">, meaning a connection with <\/span><b>limited permitted capacity automatically regulated by technical means at the connection point<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A key provision states that <\/span><b>if the developer prepares the project documentation independently, the transmission or distribution system operator may not refuse flexible connection<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For hundreds of projects that have been waiting in queues due to grid capacity constraints, this creates a <\/span><b>real pathway to grid access<\/b><span style=\"font-weight: 400;\">. If the limitation is temporary, the date of full capacity availability will be determined by the <\/span><b>grid development plan<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">The methodology for payment for flexible connections must be adopted by the <\/span><b>National Energy and Utilities Regulatory Commission (NEURC)<\/b><span style=\"font-weight: 400;\"> within two months.\u00a0<\/span><span style=\"font-weight: 400;\">This provision is particularly relevant for <\/span><b>wind energy projects in sparsely populated regions with excellent wind resources but weak grid infrastructure<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><\/blockquote>\n<h5><b>Renewable Energy Facilities in Occupied Territories: Finally, Clear Rules<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Since the start of the full-scale invasion, renewable energy facilities located in <\/span><b>temporarily occupied territories<\/b><span style=\"font-weight: 400;\"> existed in a legal vacuum.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Some producers continued delivering electricity to the <\/span><b>Unified Energy System of Ukraine<\/b><span style=\"font-weight: 400;\">, while others were uncertain about their obligations to creditors and partners.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The law addresses this issue systematically.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Within <\/span><b>30 days after the law\u2019s entry into force<\/b><span style=\"font-weight: 400;\">, the <\/span><b>Ministry of Energy<\/b><span style=\"font-weight: 400;\"> must establish a <\/span><b>Special Commission<\/b><span style=\"font-weight: 400;\"> involving:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">NEURC<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Transmission System Operator<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">distribution system operators from occupied territories<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Security Service of Ukraine (SBU).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Within <\/span><b>45 days<\/b><span style=\"font-weight: 400;\">, the commission must approve a list of affected facilities and determine the exact dates of suspension and restoration of electricity delivery.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Based on this list, the transmission system operator will maintain an official registry.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">From the date of inclusion in the registry, <\/span><b>commercial metering is set to zero<\/b><span style=\"font-weight: 400;\">, meaning <\/span><b>no payments are made for electricity generated during occupation<\/b><span style=\"font-weight: 400;\">. Payments already made must be returned.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">Legal liability for damages to producers is explicitly assigned to <\/span><b>Russia as the occupying state<\/b><span style=\"font-weight: 400;\">, an important provision for future <\/span><b>reparation claims in international tribunals<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><\/blockquote>\n<h5><b>Energy Storage and Heat Sector: Less Visible but Important Changes<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">For all electricity producers \u2013 both those operating under the <\/span><b>feed-in tariff or market premium<\/b><span style=\"font-weight: 400;\"> and those without support \u2013 the law eliminates the key tariff barrier for energy storage deployment: <\/span><b>double charging for network services<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">From now on, transmission and distribution tariffs will be calculated based on the <\/span><b>absolute difference between monthly electricity withdrawal and injection by the storage facility<\/b><span style=\"font-weight: 400;\">, rather than the total gross flows.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For example:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">if a storage system withdraws <\/span><b>1000 MWh<\/b><span style=\"font-weight: 400;\"> and injects <\/span><b>900 MWh<\/b><span style=\"font-weight: 400;\">,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">tariffs will apply only to <\/span><b>100 MWh<\/b><span style=\"font-weight: 400;\">, not <\/span><b>1900 MWh<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">This fundamentally changes the <\/span><b>economics of electricity storage for producers<\/b><span style=\"font-weight: 400;\">, eliminating discrimination compared to standalone storage operators.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Administrative requirements have also been simplified:<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> A license is required only if the storage facility\u2019s capacity <\/span><b>exceeds 5 MW at a single site<\/b><span style=\"font-weight: 400;\">. Smaller systems may operate <\/span><b>without a license<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Storage operators are also allowed to <\/span><b>sell electricity to a neighboring consumer at the same connection point without obtaining a supply license<\/b><span style=\"font-weight: 400;\">, enabling <\/span><b>industrial microgrid models<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Heat suppliers using renewable sources \u2013 such as <\/span><b>biomass boilers, cogeneration plants, and geothermal installations<\/b><span style=\"font-weight: 400;\"> \u2013 have also received a <\/span><b>\u201c30-day silent approval\u201d rule<\/b><span style=\"font-weight: 400;\">: if the regulator does not approve or reject the tariff within a month, the tariff submitted in the application is considered approved.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For a sector historically plagued by delays in tariff regulation, this significantly <\/span><b>rebalances the relationship between business and bureaucracy<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h5><b>Conclusion<\/b><\/h5>\n<p><span style=\"font-weight: 400;\">Law No. 4777-IX is <\/span><b>not a single sweeping reform but a package of targeted changes<\/b><span style=\"font-weight: 400;\">, each addressing a specific barrier.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Together, these provisions create a new framework for the energy market:<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"> the state prioritizes <\/span><b>manageable and flexible renewable generation<\/b><span style=\"font-weight: 400;\">, investors receive <\/span><b>longer planning horizons and lower financial entry barriers<\/b><span style=\"font-weight: 400;\">, and the market gains <\/span><b>legal certainty in areas where it has been lacking since February 2022<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Subordinate regulatory acts must be adopted within <\/span><b>two months<\/b><span style=\"font-weight: 400;\">.
