Legal mechanism ”.
Forced shutdown and restriction is a negative phenomenon for the stability of solar generation. Therefore, the Association has been dealing with this issue for a long time. Last year, at the initiative of SEAU and other industry associations, a working group was established on the basis of NEC Ukrenergo, which worked out changes that were later approved by the National Commission for State Regulation of Energy and Utilities (NCSREU), which became the methodology and procedure for reimbursing restrictions.
The legal field regarding compensations is regulated in detail. In any case, the TSO (transmission system operator) will have to pay for all restrictions and the “green” tariff. The only and still the biggest problem is the lack of a source of funding.
“We have to help Ukrenergo to find a source of funding. It is no less important to make this mechanism as automated as possible” – Artem Semenishin added.
The webinar experts told in more detail about the legal and technical mechanisms of SPP restriction, the calculation of the amount of electricity not released by the producer and the algorithm for applying for compensation with specific examples:
– Olga Savchenko, Chairman (Head) of the SEAU Committee on Legal Support of the Solar Energy Industry, Partner of “Altelo” Law Firm;
– Maria Zadorozhna, legal adviser to SEAU;
The participants of the online event were quite active in the discussion. Many of them have already received the TSO command for restrictions this year, but not all of them understood the nature of such teams.

“ASEU’s position – the process of compensation payments for limiting the generation of RES should be started” – said Artem Semenyshyn – Director of the Solar Energy Association of Ukraine during the webinar “How to get compensation for SPP restrictions?
